AtomicPlayer's Privacy Policy seeks to clarify for visitors and users how we record, protect, use, disclose, transfer, and store our customers' information. 1. General data collection
AtomicPlayer’s priority is to ensure the privacy and security of the information of registered users (“User”). Therefore, the main purpose of this Privacy Policy is to define the policies adopted by AtomicPlayer regarding the collection, use, and disclosure of personal information. By using AtomicPlayer’s products and accepting this Privacy Policy at registration, the User acknowledges and accepts the adoption of the practices described in this instrument, as provided in Brazilian law, principally the Civil Rights Framework for the Internet (Law No. 12.965/2014) and the General Data Protection Law (Law No. 13.709/2018 – LGPD).
AtomicPlayer reserves the right to modify this Privacy Policy at any time to meet legal and/or technological requirements. All modifications will be announced through our official channels of communication with the User, with the effective date. By remaining on the system, the User demonstrates agreement with the modifications made.
2. Registration
AtomicPlayer’s objective in allowing the User to voluntarily enter their information is to facilitate navigation in AtomicPlayer’s products/services and the use of its tools. Therefore, the User’s proactivity in entering their data means that they want to benefit from the tools of AtomicPlayer’s products/services and agree to the privacy terms, including their sharing with third parties, affiliates, and/or partners of AtomicPlayer, subject to the purpose of the service. When selecting suppliers and partners, AtomicPlayer considers their respective data-processing practices and the concern to maintain due security against improper sharing.
To become a User, the first step is registration, in which name, email, and phone number are required. If the User chooses not to provide the requested personal information, in many cases AtomicPlayer will not be able to provide access to its products/services or content, or respond to questions. If the User enters personal data of third parties for the proper provision of services, the User is solely and exclusively responsible for ensuring that the third party has authorized the entry of their data, releasing AtomicPlayer from any indemnification arising from that processing of the third party’s data.
The User has the right to access, modify, correct, and delete the data relating to their decision to become a User, as well as the other rights provided in art. 18 of the LGPD. If the User revokes their consent and authorization for the use of their data, AtomicPlayer will remove their data from future queries, but some information will remain archived for the sole and exclusive purpose of allowing AtomicPlayer to meet the legal requirements of the Civil Rights Framework for the Internet and its legitimate interest, in the ways permitted by law.
All personal information is protected, and we guarantee it will not be improperly shared. The information may be combined with other data in order to improve our products, content, and communication with the User. The User undertakes to notify AtomicPlayer immediately, at [email protected], about any unauthorized use of their account, as well as unauthorized access by third parties. The User is solely responsible for the operations carried out in their account, since access is only possible by entering the password, the knowledge of which is exclusive to the User.
3. Use of the personal data and information collected
The personal and registration data provided by customers and collected by the platform, as well as any other information collected, may be used for communication between our team and you, by sending notifications about your activity with AtomicPlayer’s tools, as well as system alerts and notifications. In addition, the data may be processed and used for the following purposes:
- To enable the effective provision of the services offered by AtomicPlayer, efficiently and effectively, allowing their operation in an agile and secure manner, including the hosting, processing, and display of videos;
- To generate performance reports, retention metrics, heatmaps, revenue attribution, and other analytics related to the videos hosted by the User;
- To assist, whenever necessary and appropriate, in communication between users, especially in any disputes related to content quality, copyright, and intellectual property;
- To carry out analyses and studies related to the behavior, interest, and demographics of customers, in order to understand their demands and needs and provide more suitable, efficient, and interesting services, improving the usability experience of AtomicPlayer’s tools;
- To improve our commercial and marketing strategies, aiming to enhance the services offered;
- To send customers, through messages, information relating to AtomicPlayer’s products, services, advertising, promotions, and news. Customers may request, at any time, the removal of their data from the promotional and/or advertising mailing lists managed by AtomicPlayer.
4. Storage and protection of the personal data collected
All customers’ personal data obtained during navigation, registration, use of the platform, or at any other moment of contact/communication between the user and the platform will be stored in our database for a minimum period of 12 (twelve) months, or for a longer period provided it is determined by judicial and/or administrative order, under applicable law, or for legitimate purposes of developing and offering services to users.
The personal data provided to AtomicPlayer or otherwise collected by the platform will be stored in secure databases, with access restricted only to employees with the proper credentials, who are obliged to maintain the confidentiality of the information and not to use it improperly. AtomicPlayer may store and process the personal data collected and other information on servers located in Brazil or abroad.
5. Disclosure to third parties of the registration and personal data collected
You agree that, in an attempt to prevent illegal activities, in cases of suspected fraud, disputes, complaints about content, or any indication of an offense committed by customers — including the dissemination of SPAM and situations involving potential threats to someone’s physical safety — the personal and registration data of the customers involved may be provided to the injured parties. In certain cases, if it deems it necessary, AtomicPlayer may provide the data collected to bodies and entities that intervene in the investigation or resolution of disputes between customers or between customers and third parties, such as insurers, arbitration courts, and other competent administrative bodies.
Likewise, you agree that AtomicPlayer may share the personal and registration data collected with outsourced service providers, in order to enable the development of their respective activities and allow the improvement of the platform’s services and operations, such as, but not limited to, services for: hosting and CDN, data backup, fraud prevention, email providers and databases, payment processors and gateways, and the issuance of invoices. In such cases, AtomicPlayer requires all service providers with which it shares users’ personal data to include in their contracts provisions that guarantee due protection, secrecy, and confidentiality in data processing.
You further agree that, in any corporate transaction involving the restructuring of the business group of which AtomicPlayer is part, as well as the acquisition and/or sale of shares and assets, the personal data collected may be considered one of the commercial assets to be transferred. Except for the cases mentioned in this Privacy Policy, the personal and registration data collected directly by AtomicPlayer, as well as platform access logs (IP address, date, time, and time zone) and data relating to transactions carried out, may only be revealed to third parties, without prior notice, in the following cases: (a) applicable legislation, regulation, legal process, or governmental request; (b) compliance with the investigation of possible violations; (c) fraud or security; or (d) protection against harm to the rights, property, or safety of AtomicPlayer, our users, or the public, in compliance with Law 12.965/2014 and other applicable legislation.
6. Retention of registration and personal data after account deletion
AtomicPlayer will not retain personal information for longer than necessary for the fulfillment of the purpose for which it was processed, including the security of processing in compliance with legal and regulatory obligations (for example, audit, accounting, and statutory retention periods), litigation regarding the processing, and for the establishment, exercise, or defense of its legitimate interest.
You may delete your account with AtomicPlayer at any time, by accessing the platform’s user settings. At the customer’s request, AtomicPlayer will proceed with the definitive deletion of the registration data they provided within a maximum period of 15 (fifteen) days. Access logs (IPs), if any, will be discarded as they reach 180 (one hundred and eighty) days of storage, under the terms of Law 12.965/2014 and other applicable legislation.
7. Data of video viewers
Due to the nature of the service, AtomicPlayer collects and processes data related to the viewers of the videos hosted by Users, such as playback records, retention, engagement, device, browser, approximate location, and IP address, for the purpose of generating the metrics and analytics made available to the User. In relation to this processing, the User who hosts and distributes the videos acts as the controller of their viewers’ data, with AtomicPlayer, as a rule, being the processor, handling such data according to the User’s instructions and for the provision of the service. The User is responsible for presenting privacy notices to their viewers and for obtaining the legal bases applicable to the processing of the data collected through the videos they publish.
8. Prohibition of SPAM
AtomicPlayer vehemently repudiates any and all practices that promote SPAM of any kind. Thus, we are committed to ensuring that the messages sent by the platform are always of interest or importance to their respective recipients. Users may, at any time, choose whether or not to receive emails from AtomicPlayer, simply by adjusting their preferences or cancelling the subscription for promotional and/or advertising emails. If it is found that platform users are using SPAM, AtomicPlayer, at its sole discretion and regardless of prior notice, may immediately delete the account of the customers and users.
9. Our commitment to your privacy
To ensure that your personal information is secure, we communicate our privacy and security guidelines to employees and strictly enforce privacy safeguards within the company. We reserve the right to modify this Privacy Policy at any time, and changes will take effect after the publication of the modified Privacy Policy. When there is a change, AtomicPlayer will notify its users by email or by a publication in a prominent area of the platform. If you continue to use the tools offered after the change has been communicated, this will be considered your consent and acceptance of all the terms and conditions contained in the amended Privacy Policy.
